Lovefern ("the app", "the Service") is provided by David Dempsey ("I", "me", "my"). By downloading, accessing or using the app, you agree to these Terms of Service. If you do not agree, please do not use the app. These terms should be read together with the Privacy Policy.
The Service
Lovefern is a playful app for couples to share small everyday signals, such as moods, love notes, doodles and virtual affection, and to grow a shared virtual plant together. It is meant to be light and fun. It is not a substitute for professional advice of any kind, including relationship, medical, psychological or financial advice, and nothing in the app should be relied on as such.
Eligibility
You must be at least 13 years old to use Lovefern, and old enough in your country to agree to these terms and to make any purchases. If you are under the age of majority where you live, you should only use the app with the involvement of a parent or guardian.
Your account and pairing
To use Lovefern you create an account and pair with one partner using an invite code. You are responsible for keeping your account details secure and for activity that happens under your account. You agree to provide accurate information and to keep it up to date. One shared fern belongs to a pair of partners; the app is designed for two people who both consent to sharing a space.
Your content
You keep ownership of the content you create in the app, such as your notes, doodles and moods. To operate the Service, you grant me a limited licence to store, process and display that content for the purpose of running the app and delivering your content to the partner you have paired with. I do not claim ownership of your content and I do not use your private shared content for advertising.
Acceptable use
Because content you create is delivered to your partner, you agree not to use the app to create or send content that is unlawful, abusive, harassing, threatening, hateful, or otherwise objectionable. I operate a zero-tolerance policy for objectionable content and abusive behaviour. You can report content and block or unpair from a partner within the app. I may remove content, suspend or terminate accounts that breach these terms, and where appropriate, take other action. You also agree not to misuse the Service, interfere with its operation, or attempt to access it in unauthorised ways.
Subscriptions and payments
Lovefern offers a free experience and an optional paid subscription that unlocks additional features. Key points:
- Payment is charged to your Apple App Store or Google Play account. I do not process or store your payment details.
- A single subscription covers both partners in a pair.
- Where a free trial is offered, it converts to a paid subscription unless you cancel before it ends.
- Subscriptions renew automatically until cancelled. You manage or cancel a subscription through your App Store or Google Play account settings, not within the app.
- Prices may change, and I will give notice of changes as required by the app stores. Refunds are handled according to the policies of Apple or Google.
The Couple's Promise
As part of how Lovefern is run, I commit that: one subscription covers both partners; the app shows no ads; and there is no charge to repair a streak or to undo a lapse. These commitments describe how the Service is intended to work.
Intellectual property
The app itself, including its design, the Love Fern character, artwork, branding and code, is my property or that of my licensors and is protected by law. These terms do not give you any right to use my branding or content except as needed to use the app normally.
Termination and account deletion
You can stop using Lovefern at any time and delete your account from within the app. I may suspend or end your access if you breach these terms or if I stop offering the Service. Deleting your account ends your pairing and removes your personal content from the active Service, as described in the Privacy Policy.
Disclaimers
The app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. I do not warrant that the app will always be available, uninterrupted, or error free. Lovefern is for fun and connection, not for therapy, counselling or professional advice, and outcomes for any relationship are not promised.
Limitation of liability
To the fullest extent permitted by law, I will not be liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, the app. Nothing in these terms limits liability that cannot be limited under law, including liability for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are not affected.
Changes to these terms
I may update these terms from time to time. Changes are effective when posted on this page, and I will update the date at the top. Continuing to use the app after changes are posted means you accept the updated terms.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, without affecting any mandatory consumer rights you have in your country of residence.
